Below is an overview of the preliminary steps for filing a mechanic’s lien in the state of Arkansas.

COMMERCIAL:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notices (if not paid):
    1. Arkansas 75-Day Notice of Non-Payment:
      • Required to be sent within 75 days of the last date materials or labor were supplied to the job.
      • This notice is available on the BICA member portal.
    2. Notice of Intent to File a Lien:
      • Required to be given at least 10 days before filing a lien.
      • This notice is available on the BICA member portal.

RESIDENTIAL:

  • Upfront Notice:
    • As a precaution, BICA sends the “Pre-Construction Notice to Owner”.
      • This notice is normally given by the General Contractor to the Owner before the job begins.
      • However, as no lien rights exist if it is not given by the GC, BICA sends a copy of this as the upfront notice on all Residential jobs.
  • Follow-up Notice (if not paid):
    • Notice of Intent to File a Lien
      • Required to be given at least 10 days before filing a lien.
      • This notice is available on the BICA member portal.

PUBLIC:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notice: There is no statutory follow-up notice.
