Below is an overview of the preliminary steps for filing a mechanic’s lien in the state of Hawaii.

COMMERCIAL:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notices: There is no statutory follow-up notice.

RESIDENTIAL:

  • Same handlings as for Commercial jobs.

PUBLIC:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notices:
    • Notice to Contractor (“Little Miller Act” notice):
      • Required to be sent to the Contractor and Surety within 90 days of last delivery or work on the job.
      • This notice is available on the BICA member portal.
