Below is an overview of the preliminary steps for filing a mechanic’s lien in the state of Missouri.
COMMERCIAL:
- Upfront Notice: BICA sends a Courtesy Notice.
- Follow-up Notice (if not paid):
- Notice of Intent to File Mechanics’ Lien:
- Required at least 10 days prior to filing a lien.
- This notice is available on the BICA member portal.
RESIDENTIAL:
- Upfront Notice:
- Existing Residential Property:
- Courtesy Notice and Request for Notice of Consent:
- No upfront notice is required.
- Instead of a generic Courtesy Notice, BICA includes wording to request a copy of the “Consent of Owner”. If the owner does not sign the consent form, claimants have no lien rights. You will need a copy of the signed form to file a lien.
- New Residential Property:
- Notice of Rights:
- Required to preserve your lien rights in the event the property is sold before you are paid.
- This notice is filed with the County Recorder
- BICA also mails a copy to job principals as a courtesy notice.
- Follow-up Notice (if not paid):
- Notice of Intent to File Mechanics’ Lien:
- Required at least 10 days prior to filing a lien.
- This notice is available on the BICA member portal.
PUBLIC:
- Upfront Notice: BICA sends a Courtesy Notice.
- Follow-up Notice: There is no statutory follow-up notice.
