Below is an overview of the preliminary steps for filing a mechanic’s lien in the state of Nebraska.

COMMERCIAL:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notice: There is no statutory follow-up notice.

 

RESIDENTIAL:

  • Upfront Notice:
    • Notice of Right to Assert a Lien:
      • This notice is optional.
      • BICA uses this as its upfront notice on residential jobs as lien claims are only valid for the amount unpaid the general contractor at the time this notice is received.
  • Follow-up Notice: There is no statutory follow-up notice.

PUBLIC:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notice (if not paid):
    • Notice to Contractor:
      • Required within four months of last delivery.
      • This notice is available on the BICA member portal.
