Below is an overview of the preliminary steps for filing a mechanic’s lien in the state of North Dakota.

COMMERCIAL:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notice (if not paid):
    • Notice of Intent to File a Lien:
      • Required at least 10 days before filing a lien, which means within 80 days after last delivery (since a lien must be filed within 90 days of last delivery).
      • Must be sent to the Owner on the project.
      • This notice is available on the BICA member portal.

RESIDENTIAL:

  • Same as for Commercial jobs.

PUBLIC:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notices (if not paid):
    • Notice to Contractor:
      • Required within 90 days of last delivery.
      • This notice does not apply to State Highway jobs
      • This notice is available on the BICA member portal.
    • Notice of Claim: (Department of Transportation)
      • Applies to State Highway projects for the Department of Transportation.
      • Required within 180 days of last delivery
      • Amount of claim must include interest calculated per statute guidelines.
      • This notice is available on the BICA member portal.
