Below is an overview of the preliminary steps for filing a mechanic’s lien in the state of Delaware.

COMMERCIAL:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notices:
    • There is no statutory follow-up notice.

RESIDENTIAL:

  • Same handlings as for Commercial jobs. with the exception that any lien is only valid to the amount the owner has not yet paid the contractor.

PUBLIC:

  • Upfront Notice: BICA sends a Courtesy Notice.
  • Follow-up Notices:
    • There is no statutory follow-up notice.
